Project of modification of Constitution voted by deputies Immunity of judges could be limited
The judges’ immunity could be limited. This is stipulated in a project of modification of the Constitution which was voted in the first reading by the deputies.
If they commit infringements, the magistrates could be investigated, without asking the agreement of the Superior Council of the Magistracy. The document also stipulates that the judges of the Supreme Justice Court will no longer be named by the Parliament, but by the president, at CSM’s proposal.
Also, the judges of the trial court and of the Appealing ones could no longer be named on a mandate of five years, but till the accomplishment of the age limit for pensioning.
And the president will have the right to refuse once the application for the position of judge. The extension with two more years of the mandate of a CSM member is referred to in another stipulation of the project.
They will be able to occupy a unique mandate, for six years. It is also proposed the exclusion from the CSM componence of the general prosecutor and CSJ president.
