The Venice Commission doesn't have the right to change the decisions of the Constitutional Court or even to comment on these. This statement was published in the 2010 report regarding the political situation of Ukraine.
"The Venice Commission should check on the Constitutional Court's decision, but don't have the right to change these. As a result, the Commission doesn't take any decisions in such cases, whether the CC is right or no".
The opinion of the European institution was requested after the Kiev Constitutional Court decided on September 30, 2010 to change the mandate term for 4 years, but not 5 as it was decided in the 2004 version of the Constitution.
