The former head of the Criminal Police Service of the Hânceşti Police Inspectorate was culpably acknowledged to have exceeded his service duties, accompanied by the use of a gun and the murder of a young man. By the partial cumulation of the punishments, the court imposed a final sentence of 12 years and 6 months imprisonment, depriving them of the right to hold certain positions for seven years.
He was also obliged to pay moral and material damage of 320,000 lei to the injured party's successors.
The criminal proceedings against the owner of the recreational complex in which the tragedy occurred and which had been accused of complicity in the murder, was terminated by the magistrates.
The tragedy took place on the night of June 21, 2018, when three young people decided to cool off in the complex's swimming pool outside of the hours of the program and without requesting permission from the leisure center administration.
The owner would have asked the policeman to help him detect and punish those entering the rest of the resting area outside the program and causing damage. As a result, in the absence of legal grounds and powers, in the absence of a complaint about the commission of a crime, the two have organized an ambush for the respective pool with the use of weapons.
Prosecutors found that the two had used their weapons even if there was no imminent threat to their security, since no person in the local area was armed to be in danger. Thus, one of the three young people who bathed that night in the pool was seriously injured and died shortly.
On the same day, the policeman and the owner of the recreation center were detained.
Prosecutors will challenge the sentence, asking for the aggravation of the punishment for the former policeman, but also condemning the owner of the leisure complex.
