Bailiffs will be required to pick up the means of transport declared for search within three working days of the release of the detention by the internal affairs bodies.
According to the project, means of transport are declared in search of the bailiff by issuing a contract. On this basis, the owner of the means of transport can be removed from the management by the staff of the internal affairs department and can be detained for up to three working days. On expiry of which the means of transport is returned to the owner or the legal owner as the case may be.
At the same time, the bailiffs will immediately send to the internal affairs body the lifting of the enforcement measures.
The authors point out that the means of transport detained at the request of the bailiffs are stationed for long periods of time, without any action being taken against them. During the year 2017, under the court orders, the Border Police detained 1360 means of transport, the security and integrity of which was ensured by its staff.
Similarly, the bailiff will be entitled to request and receive, free of charge on paper and on-line from the authorities, information relevant to the enforcement procedure unless it has access to the information system containing the data. There is no such condition at present.
