The number of cases of preventive arrest, often unjustified, could decrease. Parliament voted in first reading a draft law to amend the Criminal Code.
The authors propose that the preventive arrest should not be dictated by the magistrates if the defendant acknowledged the guilt, if the offense was committed without the application of physical or mental constraint, if the deed had not resulted in death and if the violation was not committed by an organized criminal group. All these conditions must be cumulative.
"The draft law will have a social impact expected by reducing the number of cases of application of preventive arrest that must remain an exceptional measure", said DPM deputy Sergiu Sarbu.
The draft is to be voted by legislators in final reading.
