Government addressed Constitutional Court regarding Minister promotion
This morning the Government has approved the decision to apprehend the Constitutional Court regarding their understanding of article 98, line 6 from the Constitution of the Republic of Moldova, regarding the actions the Prime Minister and the Parliament can take, in case the President of the Republic of Moldova repeatedly refuses to promote someone to the function of Minister.
The Government has made the decision in order to allow the Defense Ministry to continue it's activity.
Now, the Constitutional Court also has a say in this decision, but enough to overthrow others.
Therefore, the Constitutional Court will use the decision No. 15 from 23 March 1999, where it specifically said that the President promotes people into position of Minister and does not depend on the President's own will or preference.
The President is forbidden to refuse to promote someone in the Government, after the decision was made in the Parliament.
At the same time, the Court stated that the President is not allowed to deny the Parliament the promotion of a person in the Government, regardless of his personal opinion.
By not abiding, the President is breaching article No. 6 from the Republic of Moldova's Constitution of collaboration between State's institution.
