The requirements for the exercise of judicial expert activity will be simplified. In today's plenary sitting, Parliament approved a draft amendment to the Law on Judicial Expertise and Status of the Judicial Expert with the support of 60 Members.
According to the amendments, additional requirements for the exercise of judicial expert activity will be abolished. Thus, the obligation to hold the quality of a technical expert in construction, as well as the cadastral engineer's certificate and qualification of property valuers will be canceled.
Also, the provisions stipulating that persons holding a scientific title of doctor, doctor habilitate or of an academic in that specialty are exempt from the professional training and qualification examination.
The amendments imply that the judicial expert will confirm his identity through the card issued by the public judicial expertise institution, and in the case of the judicial experts who work in a judicial expertise office - by the card issued by the Ministry of Justice.
Judicial expertise is defined by the legislation in force as a scientific-practical research activity carried out in the civil, criminal or contraventional process in order to find out the truth by conducting methodical research with the application of special knowledge and technical-scientific procedures for the formulation of some reasoned conclusions with certain facts, circumstances, material objects, phenomena and processes, human body and psyche, which can serve as evidence in a judicial process.
