Democratic Party President Pavel Filip is of the opinion that new government subordinates the justice, opposes the law and recommendation of foreign partners, opposes the common sense. The official criticizes the bill Justice Ministry presented.

"The "perfect politicization formula" (approved last week by the new government to definitively subjugate its justice in the country) is criticized by the European Association of Judges for Democracy and Freedom (MEDEL).

The draft law presented by the Ministry of Justice raises "serious concerns", it is stated in their statement. Moreover, European partners are calling on the government to refrain from actions that threaten the independence of justice, by promoting laws that undermine this sector.

Former President of the Parliament, MP Andrian Candu, added with a concern that "the only achievement of the Maia Sandu Government is to improve relations with the Russian Federation".

They say, among others, about the Judges' Evaluation Commission that "such a Commission for the evaluation of judges, especially in the higher court, and, predominantly appointed by the Government, seems to be unable to provide an objective evaluation and respect for the guarantees of the status of judges ”.

Also, the European Magistrates consider "with great concern the projected change in the number of members of the Superior Council of Magistracy, by increasing the number of representatives of civil society. This proposed amendment raises concerns, as it could limit the ability of judges to decide on all issues related to the judiciary. ”

European magistrates recall that the most relevant international institutions have repeatedly emphasized the need for a significant majority of judges in the higher councils, as a guarantee of the independence of the judiciary.

In this context, the Venice Commission, in its Report on the Independence of the Judicial System - Part I: Independence of Judges (adopted by the Venice Commission at the 82nd Plenary Session, Venice, March 12-13, 2010) expressly stated that a substantial, if not the majority, of the members of the High Councils must be judges elected or appointed by their colleagues.
