The Constitutional Court of the Republic of Moldova (CCM) partially accepted the complaint filed by a group of seven deputies of the Liberal Party (PL) regarding the control of the constitutionality of some legal provisions regarding the functioning of the Russian language on the territory of the Republic of Moldova and the prohibition of the constitutionality control of the laws enacted until the entry into force of the Constitution.

"The Constitutional Court partially accepts the complaint filed by PL deputies. Articles 4, paragraph 2 of the Code of Constitutional Court and Article 31, paragraph 2, of Law 317 on 13 December 1994 on the Constitutional Court are declared unconstitutional.
 
The dissent of Law 3465 on 1 September 1989 on the functioning of the languages spoken on the territory of the Moldovan SSR is found. The other heads of the petition are declared inadmissible, "CCM President Mihai Poalelungi said.

According to the Court, the name of the law on the functioning of the spoken languages on the territory of the Moldovan SSR reflects an outdated reality. Thus, the Court found that the transitional nature of this Law, valid only for the period in which it was adopted, is also demonstrated by numerous subsequent laws which have taken over from it. Finally, the CCM stressed that the effects of declaring the obsolescence of a law are equivalent to its repeal.

We remind that the repetition was filed in January 2018. According to the arguments put forward by liberals, the Law on the Functioning of the Spoken Languages on the Territory of the Moldavian SSR consumed its existence on December 25, 1991, when all the republics of the former USSR declared their independence.

During the hearing, representatives and sympathizers of the Party of Socialists of the Republic of Moldova held a protest action against the CCM, strongly condemning the PL's initiative to abrogate the laws governing the status of Russian as a language of inter-ethnic communication.

In the action, PSRM MP Vladimir Turcan said that if the request to dismiss the Liberals' notices is not heard, mass protest actions will be followed.

The judgment of the CCM is final and can not be subject to any appeal
