Government endorsed legislative projects to modernize electricity and natural gas networks
Government has positively endorsed several legislative projects, which aim to create the legal framework necessary for the system operators to fulfill their obligations to exploit and maintain, rehabilitate, modernize the electrical networks and the natural gases.
In particular, legislative initiatives propose establishing the right of use and legal servitude, land owned by third parties for the operation and maintenance of electricity and natural gas networks, by performing revisions, repairs and other necessary interventions in order to ensure their normal operation.
"In this respect, through the amendments to the Electricity Laws No.107 and No. 108 on Natural Gas, system operators undertake to conclude with the owners of the land or property affected by the exercise of the rights of use and servitude a framework contract, which is to determine the rights and obligations of the system operator and the land or property owner, "Economy and Infrastructure Minister Chiril Gaburici explained.
Electricity and natural gas construction works involve obtaining a building permit or permissive act equivalent to the right of use and servitude of the land or immovable property for the execution of the construction works and to be obtained only with the prior consent of the owner of the land or real estate concerned.
The proposed amendments aim to ensure the recovery of the damage caused to the landowners, goods - private property, following the respective works by the system operators and respectively the inclusion of the obligation to conclude the land use contracts at the request of the system operator in all cases, in order to exclude misunderstandings between owners and electricity companies.
Also, the Government has given a positive opinion to the initiative to amend the Law on the Public Utilities Decree for works of national interest in the construction of the gas pipeline in the direction of Ungheni-Chisinau, in order to facilitate the gas pipeline construction process.
Additionally, the legislative initiative provides for the automatic recognition, in Moldova, of the studies, qualifications and attestations obtained in the European Union area of the specialists who will be involved in the construction of the Ungheni - Chisinau gas pipeline.
The document also provides for the recognition of permissive acts necessary for the execution of construction and / or reconstruction works issued by the bodies of the EU Member States. The construction of the natural gas pipeline in Ungheni-Chisinau direction is a project of national importance with a large volume of works and a large number of specialists involved.
