The Constitutional Court declared unconstitutional several provisions of the Criminal Code including some phrases that aggravates the penalties for judges who make decisions against the law - causing serious consequences or officials who abuse the service causing serious consequence, writes actual.md. 

Accordingly, the Court decided to declare unconstitutional the next provisions of Criminal Code: 

"resulting in serious consequences" - art. 189, para. (3), lit. f). The article deals with the crime of "blackmail".

"resulting in serious consequences" - art. 307, para. (2), lit. c). The article aims at "knowingly pronouncing a judgment, sentence, decision or conclusion against the law by the judge", and the provision declared unconstitutional aggravates the punishment. 

"resulting in serious consequences" - art. 327, para. (2), lit. c). The article refers to "abuse of power or abuse of service", and the provision declared unconstitutional aggravates the punishment.

"other serious consequences" - art. 329, para. (2), lit. b). The article refers to "negligence in service", and the provision declared unconstitutional provides for harsher penalties for this crime.

"Public interests or" - art. 329, para. (1). The article deals with "negligence in service".

”The actions provided in par. (1), resulting in serious consequences ”- art. 335, para. (1) 1. The article refers to "abuse of service", and the provision declared unconstitutional provides for harsher penalties for it.

The judgment of the Court was delivered on the basis of several complaints, linked in a single case.

In the case of art. 307, which refers to "knowingly pronouncing by the judge a judgment, sentence, decision or conclusion against the law", about 11 notifications were submitted by the lawyers of the judges involved in one of the most resonant files - "Laundromat". The provision declared unconstitutional provides for these prison sentences from 3 to 7 years with the deprivation of the right to hold certain positions or to exercise a certain activity for a term of up to 5 years.

Until the Court's ruling, the magistrates' files were suspended.

The lawyers who raised the allegations, invoked the unclear and unpredictability of the phrase "serious consequences".

The motivation and decision of the Court will be published on the institution's website. The decision is considered in force from October 17.

With the ruling, the Court also issued an Address to the Parliament requesting the completion of criminal law.

Earlier the press wrote that Veaceslav Platon had prepared $ 10 million for representatives of the current government, which will help him get out of prison.

Moreover, after the change of power, Platon has been visited by former PSRM MP Vladimir Turcan in the penitentiary no. 13. Vladimir Turcan confirms this information. 

Shortly after these visits, Țurcan became the judge of Constitutional Court and then the institution's President.
