City Hall could compensate millions of lei for illegally dismantling advertising panels?
The war between the City Hall and the economic agents in the field of street aads continues. They announced that they will sue the municipality, because it lacked authorizations and illegally dismantled the panels in which they invested millions of lei. The compensations that the City Hall could pay amount to millions of lei, they say.
So far, about 600 billboards have been dismantled in Chisinau. According to mybusiness.md, which quotes the deputy head of the Architecture and Urbanism Department Andrei Vatamaniuc, in the next period almost 400 panels will be dismantled. The reason, authorities say, is the expiration of the permit. However, the president of the Association of Advertising Agencies, Galina Zablovscaia, claims that this is not enough to dismantle the panels and that this is because the authorizations were automatically extended. She says that the advertising agencies have requested their extension, but the City Hall has not offered a written refusal until today. In these conditions, Law 160 on the regulation by authorization of the entrepreneurial activity expressly stipulates that in the absence of a clear written answer, the authorizations are extended by tacit approval.
"They didn't say yes or no to us, so it turns out, according to the regulations, that we are allowed, in the conditions in which they are silent. What we have now: no one in the advertising market has neither refusal nor extension of the authorization. They will have problems in court, and that will cost them millions ", said the president of the Employers' Association of Street Ads, Galina Zablovscaia.
We tried to get a reaction from the chief architect of the Capital, Svetlana Dogotaru, who signs the permits for street ads. She directed us to the deputy head of the Architecture and Urbanism Department, Andrei Vatamaniuc, who did not answer us on the phone or in the messages.
According to the Employers' Association of Street Ads, the City Hall will lose at least 27 million lei, money that reached the municipal budget from the taxes paid by the owners of the panels
