People will now be able to divorce at civil registry
On the common agreement of spouses, divorce will be able done at the civil registry. Parliament voted, in today's sitting, to change and add some laws.
Therefore, if both spouses agree, in case when they have no issues in splitting assets, decide upon growing, educating and housing minor children or one of the spouse's care, the marriage will be broken by the civil registry, responsible for the area one of the spouses lives in.
At the same time, if the couple has children and they cannot agree upon their housing, education or who will rise them, or in case when one of them does not agree to the divorce, the case will be take to the court.
The changes also foresee completion of the Code of Civil Procedure of Republic of Moldova with a new article, regarding the way documents are submitted through integrated file management Program. Therefore, court summoning, appeals, court orders, or any other requests will be submitted through integrated file management Program, which will be used by the whole Judiciary from Republic of Moldova.
In such cases, the request must be signed electronically in advance, while annexed documents are submitted through integrated file management Program as signed electronic documents, the same with qualified electronic signature. When submitting the documents through the program, according to the law, an obligatory proof for the qualified electronic signature will be attached.
Other changes foresee that if a person cannot be present in court, due to being abroad, serving time in jail, or disabilities, they will be able to have a hearing through video conference on request or from the office.
In the next 12 months, Government will adopt normative acts necessary for the implementation of the new laws.
The change was supported by 52 deputies out of those present at the sitting.
